Since the implementation of the new style grants of probate we have seen an increasing delay on receiving sealed grants from the probate registry.
HMCTS have informed the Law Society that:
- Registries have moved on to a new case management system and this move necessitated a period of training
- There were wider, unexpected, technical issues across the HMCTS probate infrastructure which took the new system offline for four days
- HMCTS acknowledge there has been an increase in applications following uncertainty around the implementation of the new probate fee structure
- The level of enquiries coming into registries has also diverted resources away from addressing the current backlog
We can only hope that the delays do not increase over the summer months and that any staff shortages during this time are addressed.
